These Terms of Use govern access to and use of PerforaScan, a digital operational diagnostic platform provided by SUSTYC. By creating an account, completing onboarding, uploading files, or using the platform, you agree to these Terms.
PerforaScan is intended for business and professional use. By using the platform, you confirm that you are authorized to act on behalf of the organization, company, or site for which you create an account or submit information.
You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate account, company, and billing information and keep it up to date.
PerforaScan allows users to upload videos, images, documents, questionnaire responses, and other operational information to generate diagnostics, recommendations, action plans, reports, and progress tracking.
PerforaScan may use artificial intelligence and automated analysis to generate findings, recommendations, estimates, and reports. These outputs are provided for decision-support only. They are not legal, financial, engineering, safety, tax, insurance, or regulatory advice. You are responsible for reviewing all outputs, validating assumptions, and obtaining professional advice before acting on any recommendation.
You retain ownership of the files and content you upload. You grant SUSTYC a limited license to host, store, process, analyze, transmit to service providers, and generate outputs from your uploaded content solely to provide, secure, support, and improve the service.
You confirm that you have all rights, permissions, notices, and consents required to upload the content, including content that may show employees, contractors, customers, visitors, equipment, facilities, documents, confidential information, or third-party materials.
You must not use PerforaScan to upload, submit, or process illegal content, infringing content, malware, content you are not authorized to use, highly sensitive information without authorization, or personal information without proper authority or consent. You must not attempt to reverse engineer, disrupt, overload, scrape, or gain unauthorized access to the platform.
Both parties may access confidential information. Each party agrees to use reasonable care to protect confidential information and to use it only for the purposes of providing or using the service.
SUSTYC owns the platform, software, designs, workflows, models, templates, methods, dashboards, and related intellectual property. You may use the reports and outputs generated for your organization's internal business purposes, subject to these Terms. You may not resell, white-label, copy, or reproduce the platform or its outputs as a competing service.
The platform may rely on third-party service providers, including hosting, storage, authentication, payment, email, analytics, and AI processing providers. Your use of the platform may involve the processing of data by these providers as described in the Privacy Policy and Subprocessors / AI Processing Notice.
Paid subscriptions, if applicable, are billed according to the plan selected. Unless otherwise stated, subscriptions renew automatically until cancelled. You are responsible for applicable taxes, fees, and charges. Payment processing may be handled by third-party payment providers.
SUSTYC may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay applicable fees, or misuse the platform. You may stop using the service at any time.
The service is provided "as is" and "as available." SUSTYC does not guarantee that the service will be uninterrupted, error-free, or that every recommendation will produce a specific result.
To the maximum extent permitted by law, SUSTYC is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. To the maximum extent permitted by law, SUSTYC's total liability for claims related to the service is limited to the amounts paid by you to SUSTYC for the service during the twelve months before the event giving rise to the claim.
You agree to defend and indemnify SUSTYC against claims, damages, liabilities, and expenses arising from your uploaded content, your violation of these Terms, your misuse of the service, or your lack of rights or consents for submitted materials.
These Terms are governed by the laws of Quebec and the applicable laws of Canada, unless mandatory laws in your jurisdiction require otherwise.
We may update these Terms from time to time. If material changes are made, you may be asked to accept the updated version before continuing to use the platform.
